consent for PICC insertion

I have been following the forums here for a short time since instituting a PICC team at our facility.  I appreciate all the valuable knowledge and insight provided.  My issue is that we started a team 7 months ago and the biggest obstacle has been consent.  We have been requiring the ordering MD obtain consent which has rubbed some the wrong way.  Our legal department is on the verge of changing the policy but would like some standards to reference as far as risks associated with the procedure.  My response was that we could easily formulate a risk/benefit/alternative education sheet to outline these questions and the reply was that we needed something to reference.  Anyone have any ideas?

Have you checked the Download section of this website? There should be samples of these forms there. If you mean published studies to reference, there is a ton of literature about outcomes with PICCs. I can easily understand the physicians response to your expectation that they obtain the written consent for a procedure you are performing. If the nurse performs the procedure, the nurse should be the one doing the education and obtaining the signature on the piece of paper. True informed consent requires the education piece and is not limited to a signed form. You also must include alternatives to a PICC along with risks, benefits, procedure, etc.

We developed our own consent

We developed our own consent that the PICC nurse or the radiologist can use for consent and we get our own consents signed. This form was reviewed by our legal department and they were very specific as to explaining risks and benefits as well as alternatives. We just actually revised the consent with our current attorney who shortened several of the statements to make it more concise and incorporate current practice so that the interventional radiologists and PICC RNs can use the same consent.

Based on the court cases I have consulted on, the standard that applies is what is "reasonable and prudent". Your risk managers may have access to a legal department that can research what is being examined in current cases in your area.  You may also want to contact departments that place PICCs in other hospitals in your area, and follow what they are doing, as that is what sets precident.
